The customer is responsible for final proof and layout approval before printing. Viva Prints is not liable for errors in an approved product caused by language, grammar, graphics, bleeds, damaged fonts, overprinting, form fields, files not built to template, or incorrect page order.

Website and production materials are protected by copyright. You may not reproduce trademarks, service marks, logos, photographs, artwork, writing, or other content unless you own it or have permission to use it. Viva Prints may reject unlawful, explicit, pornographic, or otherwise prohibited material.

Information, text, photographs, graphics, artwork, and other materials supplied by a customer remain the customer’s responsibility. You agree not to submit unlawful, threatening, defamatory, obscene, infringing, or unauthorized content, or use our services for spam or other prohibited solicitation.

Viva Prints does not pre-screen every submission but may remove or reject content that violates these terms. We may preserve or disclose content when reasonably necessary to comply with law, enforce these terms, respond to third-party claims, or protect rights, property, or safety.

Any legal action or proceeding arising from access to or use of this website shall be instituted in Alberta. You agree to the jurisdiction and venue of the Alberta courts.

To the fullest extent permitted by law, Viva Prints and its licensors, suppliers, vendors, officers, directors, employees, and agents are not liable for special, incidental, indirect, or consequential damages, including loss of use, data, or profits, arising from website use, service interruption, delay, mistake, omission, or unauthorized use. Viva Prints reserves the right to refuse service.

You agree to indemnify and defend Viva Prints and its licensors, directors, officers, and employees against claims, liabilities, damages, costs, and reasonable legal expenses arising from your breach of these terms or from text, photographs, images, graphics, or other material you incorporate into printed products.

Artwork and images should be supplied in CMYK colour mode at a minimum of 300 DPI. Viva Prints is not responsible for colour shifts caused by RGB or spot-colour conversion, or for fuzzy, distorted, or pixelated output resulting from customer-supplied files.

Screen proofs predict layout, text, proportion, and placement, but not exact colour or ink density. Paper, coating, equipment, inks, lighting, and screen calibration affect colour. Reasonable variations between proofs and finished printing are expected and constitute acceptable delivery.

Viva Prints will make reasonable efforts to trim and fold accurately but is not liable for variances up to 0.0625 inches on each side. Artwork should account for trim, bleed, fold, and safety margins.

Cancellation eligibility, fees, final-sale terms, defect reporting, and available remedies are described in our Refund & Cancellation Policy, which forms part of these terms.

Turnaround and delivery times are estimates. Viva Prints is not liable for consequential damages caused by courier delays, weather, customs, incorrect addresses, equipment failure, or other circumstances outside our reasonable control. Additional delivery charges may apply when a customer supplies an incorrect address.

Links may take you to independent websites outside Viva Prints’ control. We are not responsible for their content, availability, privacy practices, or updates. A link does not imply endorsement.

Overruns or underruns not exceeding 5% of the quantity ordered constitute acceptable delivery.

The customer confirms ownership or publication rights for all submitted artwork, photos, logos, and materials, and agrees to defend and indemnify Viva Prints against claims that printing those materials infringes copyright, proprietary, privacy, or other rights.

Viva Prints does not store complete payment-card details. Payments are processed by our secure payment provider. We retain order information such as products, quantities, production specifications, artwork, payment status, and shipping details as needed to fulfil orders and maintain business records.

Without prior written consent, a customer or its affiliates shall not directly or indirectly solicit a Viva Prints employee, contractor, or consultant for two years after the customer’s last order.

Viva Prints provides printing and packaging services and does not provide legal or regulatory advice about food labelling. The customer is solely responsible for ensuring that ingredients, nutrition information, allergen warnings, certifications, logos, and other label content comply with applicable laws in every market where the product is sold.

The customer confirms it has all required permissions and approvals and agrees to indemnify Viva Prints against related claims. Viva Prints may reject content it reasonably believes violates applicable law or regulation.
